BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that:
(a) The Carrier violated the Rules Agreement, effective May 1, 1942, particularly the Scope, by the use of contract employes as freight truckers at the Ontario Street Freight Station, Philadelphia, Pennsylvania, Pennsylvania Terminal Division, December 2, 1946.
(b) Richard Millard, Andrew Ryan, Lawrence Wittenberg, and Harry Muller be allowed one hour's pay at the punitive rate as a penalty on account of this violation.
That the dispute was certified to the Third Division of the Adjustment Board ex parte by the complainant party; and
That no hearing thereon has been held, and under date of February 5, 1954, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
