STATEMENT OF CLAIM:
Claim of the System Committee of the
Brotherhood, that:
(1) The dismissal of section Laborer Alfred Howard on February
2, 1953, was in violation of the effective Agreement;
(2) The Carrier now be required to restore Section Laborer
Alfred Howard's vacation rights and to compensate him for all wage
loss suffered account of the violation referred to in part (1) of this
claim.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by complainant party; and
That no hearing thereon has been held, and under dates of June 11 and
15, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request
is hereby granted.
AWARD
Case dismissed.
