STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that:

(a) The carrier violated the Clerks' agreement when, after refusing to assign Elmer J. Cooper to position of Abstract Clerk, it also refused to grant proper investigation to develop the facts concerning his qualifications and ability. Also

(b) Claim that the Carrier now be required to hold proper investigation to develop all the facts concerning the qualifications and ability of Mr. Cooper.

FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parts by the complainant party; and

That no hearing thereon has been held, and under date of July 15, 1954, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
