THE PENNSYLVANIA RAILROAD COMPANY
STATEMENT OF CLAIM:
Claim of the General Committee of the
Brotherhood of Railroad Signalmen of America on the Pennsylvania Railroad, that:
(a) The Carrier violated the working agreement when it hired
and used a truck equipped with a ground boring machine, derrick,
and two workers, to dig holes and set T. & S. line-wire poles in them
in East Washington St. Yards, Indianapolis, Indiana, on April 24,
1950.
(b) Claim for pay for all concerned (as listed in the "Joint
Statement of Agreed Upon Facts," Brotherhood's Exhibit "A").
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by complainant party; and
That no hearing thereon has been held and under date of July 28, 1954,
the complainant party addressed a formal communication to the Secretary
of the Third Division withdrawing this case, which request is hereby granted.

Case dismissed.
