STATEMENT OF CLAIM:
Claim of the System Committee of the
Brotherhood of Railway and Steamship Clerks- Freight Handlers, Express
and Station Employes that,
(1) The Carrier violated the rules of the Clerks' Agreement,
as hereinafter stipulated, by assigning clerical position of Yard Clerk,
Douglas, Georgia, intermittent hours, and that, therefore,
(2) Yard Clerk E. Z. Holton and/or his successors, if any, shall
now be compensated for three (3) hours' minimum or actual time
on duty in excess of eight (8) hours each day, whichever is applicable, he or they are required to remain subject to intermittent hours
of service.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
That no hearing thereon has been held, and under date of September 7,
1954, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request
is hereby granted.
AWARD
Case dismissed.
