PARTIES TO DISPUTE:

THE MONONGAHELA CONNECTING RAILROAD COMPANY



STATEMENT OF CLAIM: Claim of the Brotherhood that the Carrier violated Article 19, Paragraph A, of the current Agreement when it discontinued three (3) Weighmaster positions and three (3) Yardmaster's Clerk positions and established three (3) Combination Yardmaster's Clerk and Weighmaster positions at Eastern Yard effective July 22, 1949; and


Claim that the Carrier should now pay the claims of record as of March 19, 1954 of regular Clerks who were awarded the Combination Yardmaster's Clerk and Weighmaster positions and who claim an extra day's pay for weighing cars during the hours of their regular assignments.


OPINION OF BOARD: The dispute in the instant case has been disposed of by the principle established in Award No. 1, Docket No. 1-202, of Special Board of Adjustment No. 79, involving these same parties. It will therefore be dismissed.


FINDINGS: The Third Division of the Adjustment Board, upon the whole record and all the evidence, finds and holds:


That the parties waived oral hearing thereon;

That the Carrier and the Employes involved in this dispute are respectively Carrier and Employes within the meaning of the Railway Labor Act, as approved June 21, 1934;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and






    Case dismissed in conformity with Opinion and Findings.
