PARTIES TO DISPUTE:





STATEMENT OF CLAIM: (1) That within the meaning of the Controlling Agreement the Union Depot Company, Columbus, Ohio, stands in violation thereof, in that Baggage Handler, Albert Paige, has been unjustly dealt with on the property of the Company.


(2) Therefore, the Employes claim this employe has been denied certain seniority rights as provided for in the Controlling Agreement.


(3) We claim that the name of Albert Paige should appear on the Roster of District No. 4, as of the first day his pay started in said District on the year 1949.


OPINION OF BOARD: The Rules relied on and the undenied practices in the application of said rules do not support the asserted claim.


FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon, and upon the whole record and all the evidence, finds and holds:


That the Carrier and the Employes involved in this dispute are respectively Carrier and Employes within the meaning of the Railway Labor Act, as approved June 21, 1934;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and
