STATEMENT OF CLAIM: Percy Armatead, Chef Cook of the Dining Car Department of the Chicago, Rock Island and Pacific Railroad, was suspended from service for a period of thirty days "For the reason that at the completion of your tour of duty as Chef on Dining Car 8028 on July 24, 1952, car was so unclean, unsanitary and unfit for food service that it was condemned by the U. S. Public Health Service until interior of the kitchen can be cleaned."


Claim is that Mr. Armstead be compensated for time lost resulting from this suspension and have such discipline stricken from his service record.


OPINION OF BOARD: An examination of the evidence bearing upon the facts in this case warrants our making an award, without establishing a precedent, that an adjustment be made of the discipline to a period of fifteen (15) days' suspension.


FINDINGS: The third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon, and upon the whole record and all the evidence, finds and holds:


That the Carrier and the Employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act, as approved June 21, 1934;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and


That the claim will be disposed of in accordance with the Opinion.



Claim disposed of in accordance with the Opinion and Findings.
