STATEMENT OF CLAIM: "Claim of the General Committee of The Order of Railroad Telegraphers on The Denver and Rio Grande Western Railroad:
(1) Carrier violated agreement between parties hereto when, on the 17th day of June 1953, at Cameo, Colorado, a point where no employe covered by this agreement is assigned, it required and permitted Signal Maintainer Fowler, an employe not covered by this agreement, to copy by telephone, from train dispatcher, permissive card addressed to Conductor and Engineman Train Extra 5734 East (1:26 P. M.) and Extra 5574 East (1:43 P. M.) and make delivery of same.
(2) Carrier shall, because of such violations aforesaid, be required to compensate the senior idle telegrapher (J. A. Wells) for one ay (8 hours) at the minimum rate for telegraphers on Grand Junction seniority district.
That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and
That hearing thereon has been held but not concluded, and under date of December 2, 1954 the parties addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
