PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
ST. LOUIS SOUTHWESTERN RAILWAY COMPANY
ST. LOUIS SOUTHWESTERN RAILWAY COMPANY OF TEXAS
STATEMENT OF CLAIM: Claim of the General Committee of The
Order of Railroad Telegraphers on the St. Louis Southwestern Railway that:
(a) St. Louis Southwestern Railway violated the Agreement between the parties when it refused to properly reimburse N. G.
Nash, Lewisville, Arkansas, for time consumed and lost by him,
January 29, 30 and 31, 1953, while appearing as a witness for
Carrier in an investigation held at Pine Bluff, Arkansas, commencing at 9:00 A. M., Friday, January 30, 1953; and that
(b) Claimant Nash shall be paid for this service as follows, less the
. payments previously made by the Carrier:
(1) Eight hours each, January 29 and 30, 1953 (assigned rest
days), at one and one-half times the Lewisville clerk-telegrapher
rate of pay; and
(2) Eight hours, January 31, 1953, straight time rate, for the
day lost as agent at Lewisville; and
(3) $14.10 expenses incurred attending said investigation.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex pane by the complainant party; and
That hearing thereon has been held and concluded. Under date of
February 4, 1955, the parties jointly addressed a formal communication to the
Secretary of the Third Division requesting withdrawal of this case from
further consideration by the Division, which request is hereby granted.
AWARD
Claim dismissed.
