PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
ST. LOUIS SOUTHWESTERN RAILWAY COMPANY
STATEMENT OF CLAIM: Claim of the System General Committee of
The Order of Railroad Telegraphers on St. Louis Southwestern Railway, that:
(a) The Carrier violated the Scope and other rules of the Telegraphers' Agreement when and because on December 25, 1952, it
required Agent A. L. Carraway, Fordyce, Arkansas, to suspend work
during regular hours while it turned the operation of the station over
to employes holding no seniority or other rights under the Telegraphers' Agreement, and thus deprived Agent Carraway of work
and compensation to which he was contractually entitled; and that,
(b) Agent A. L. Carraway shall now be reimbursed the exact
amount he lost by reason of such violative action on the part of
the Carrier: namely, eight hours at time and one-half rate ($3.1725
an hour), total $25.38.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
That no hearing thereon has been held, and under date of February 10,
1955, the complainant party addressed a formal communication to the
Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
AWARD
Claim dismissed.
