STATEMENT OF CLAIM:
Claim of the System Committee of the
Brotherhood that:
(a) The Carrier violated the Rules Agreement, effective May
1, 1942, as amended, particularly Rule 4-A-1(a), by ailing to allow
Charles Kassis, extra employe, Union Station, Terre Haute, Indiana,
Southwestern Division, the punitive rate of pay for his second tour
of duty within twenty-four hours on June 6, and 7, 1953.
(b) Charles Kassis, Claimant, be compensated the difference
between the pro rata rate of pay allowed and the punitive rate of
pay due on account of this violation. (Docket W-881)
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
That no hearing thereon has been held, and under date of May 20, 1955,
the complainant party addressed a formal communication to the Secretary
of the Third Division requesting withdrawal of this case, which request is
hereby granted.
AWARD
Case dismissed.
