THE BALTIMORE AND OHIO RAILROAD COMPANY
STATEMENT OF CLAIM:
Claim of the General Committee of The
Order of Railroad Telegraphers on The Baltimore & Ohio Railroad that:
(1) The Carrier violated and continues to violate the provisions
of the agreement between the parties, when it declared abolished the
three trick positions at "K" Tower, East St. Louis, Illinois, and permits or requires employes holding no rights under said agreement to
perform the work coming within the scope of the agreement formerly performed by employes covered by the agreement.
(2) The Carrier restore telegraphers to the positions at "K"
Tower to perform work properly coming within the scope of the
agreement in accordance with the rules of said agreement.
(3) For each day that employes not covered by the Telegraphers' Agreement are used to perform work covered by said agreement at "K" Tower, the Carrier shall be required to pay idle employes,
extra employes in preference, under the agreement on the seniority
district eight hours at the "K" Tower rate, for each trick named by
employes outside of the agreement, from August 1, 1949.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That hearing thereon has been held but not concluded, and under date of
July 28, 1955, the parties addressed a formal communication to the Secretary
of the Third Division requesting withdrawal of this case, which request is
hereby granted.
AWARD
Claim dismissed.
