STATEMENT OF CLAIM:
Claim of the General Committee of The
Order of Railroad Telegraphers on the Staten Island Rapid Transit Railway, that:
(a) The Carrier violated and continues to violate the provisions
of the Agreement between the parties when it required and continues
to require employes not covered by the Agreement to perform work
coming within the scope of the Agreement in connection with handling of train movements at Great Kills, New York.
(b) Commencing with October 3, 1953 and each subsequent date
thereafter that the practice continues, the Carrier will be required
to pay to the senior, idle employe (extra in preference) one day's pay
of eight hours for each day of the violation.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That no hearing thereon has been held, and under date of July 27, 1955,
the parties jointly addressed a formal communication to the Secretary of
the Third Division requesting withdrawal of this case, which request is
hereby granted.
AWARD
Claim dismissed.
