PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
MISSOURI PACIFIC RAILROAD COMPANY
STATEMENT OF CLAIM:
Claim of the General Committee of The
Order of Railroad Telegraphers on the Missouri Pacific Railroad, that:
(a) The Carrier violated the agreement between the parties
to this dispute when it arbitrarily reclassified the position of Star
Agent at Fort Scott, Kansas, to a position of Star Agent-Telegrapher,
effective Monday, ebruary 15, 1954, and failed to compensate the
employe filling this position on the basis of pay due the position of
Star Agent-Telegrapher.
(b) That the Carrier now be required to restore the classification of Star Agent and retain such classification until such time as
the position is reclassified in conformity with the rules of the agreement.
(c) Commencing with February 15. 1954 the Carrier be required to pay to the Agent, A. C. Buchanan, the difference between
the amount paid him and the amount due him as Star Agent-Telegrapher under the provisions of the rules of the agreement.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That no hearing thereon has been held, and under date of August 29,
1955, the parties jointly addressed a formal communication to the Secretary
of the Third Division requesting withdrawal of this case, which request is
hereby granted.
AWARD
Claim dismissed.
