STATEMENT OF CLAIM: Claim of the System Committee of the
Brotherhood:
(1) Carrier violated the Agreement when it assigned other
than Track Department Employes to perform the work of cleaning
Depot Platform and caring for Lawn and Station Grounds at Glenwood Springs, Colorado from May 1, 1954 to July 1, 1954.
(2) That Section Laborer Ben Sandoval be allowed four (4)
hours straight time pay for each working day May 1, 1954 to July
1, 1954, account of the violation referred to in Part One of this
Claim.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by complainant party; and
That no hearing thereon has been held, and under date of August 5, 1955,
the complainant party addressed a formal communication to the Secretary
of the Third Division requesting withdrawal of this case, which request is
hereby granted.
AWARD
Case dismissed.
