BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES



STATEMENT OF CLAIM: Claim of the Division Committee of the Brotherhood that:


(a) The Carrier violated the provisions of the Rules Agreement, effective May 1, 1942, except as amended, particularly the Scope and Rules 3-A-1, 3-B-1(a) and 3-D-1, when it used a Messenger (Group 2) to perform service in the Stenographic Pool (Group 1) located in the Consolidated Operating Office, Buffalo, New York, Northern Division, February 2nd and 3rd, 1954.


(b) Clerk Stenographer Edith F. Wagner, who was qualified and available, should be allowed eight hours pay, each day, for February 2 and 3, 1954, as a penalty. (Docket C-738)




That the dispute was certified to the Third Division of the Adjustment Board ex parts by the complainant party; and


That no hearing thereon has been held, and under date of October 6, 1955, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
