THE TEXAS AND PACIFIC RAILWAY COMPANY
STATEMENT OF CLAIM:
Claim of the System Committee of the Brotherhood that--
1. Carrier violated the Clerks' Agreement October 13 and 14,
1953 when it unilaterally and arbitrarily required Clerk E. Dosher,
Assistant Accountant Job J-512, Office Auditor Expenditures. Texas, to suspen~ work on his regular assigned position and per
form the duties attached to position J-523 at the regular rate of pay
assigned to position J-512.
2. That Clerk E. Dosher be additionally compensated at the
rate of $17.75 per day for October 13 and 14, 1953, which rate is
assigned to position J-523.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That no hearing thereon has been held, and under date of January 5,
1956, the complainant party addressed a formal communication to the Seeretary of the Third Division requesting withdrawal of this case, which request is
hereby granted.
AWARD
Case dismissed.
