SPOKANE, PORTLAND AND SEATTLE RAILWAY COMPANY
STATEMENT OF CLAIM:
Claim of the System Committee of the
Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express
and Station Employes, and of W. C. Wakeman, that the carrier violated the
current working Agreement dated January 1, 1952:
(a) When on September 26, 1952 an employe outside the scope
of the current agreement was permitted to fill a one day temporary
vacancy of Yard Clerk and Checker while the Claimant, who was
available for service, was not permitted to perform work.
(b) That claimant W. C. Wakeman, Vancouver Yard Office, be
paid for a day's pay at punitive rate as time lost September 26, 1952.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
That no hearing thereon has been held, and under date of January 11,
1956, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is
hereby granted.
AWARD
Case dismissed.
