NATIONAL RAILROAD ADJUSTMENT BOARD

THIRD DIVISION

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS, FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES

STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that:

(a) Carrier violated the provisions of the Rules Agreement effective December 15, 1952, particularly Rules 1(g) and 9(g-1), when it permitted and required Foremen in the Motive Power and Rolling Equipment Department at Bethlehem, Penna. to

(1) mark up dispatchment boards at the Bethlehem Engine Terminal on and after September 25, 1954, and

(2) assemble data for all LD and CH reports and phone same to Jersey City, N. J. from Bethlehem Engine Terminal on and after December 7, 1954, and

(b) Claimants G. R. Moyer, L. Kehoe, J. J. Fahey, P. Campbell and E. Martienssen be compensated a day's pay for September 25th, 1954 and each succeeding day until the violation cited in part 1, above, is corrected, and

(c) Claimant Torrence Seiple be compensated a day's pay for December 7, 1954, and each succeeding day until the violation cited in part 2, above, is corrected.

FINDINGS: The Third Division of the Adjustment Board finds:

That the dispute was certified to the Third Division of the Adjustment Board ex parte by the complainant party; and

That no hearing thereon has been held, and under date of February 1, 1956, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
