PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
SOUTHERN PACIFIC COMPANY (Pacific Lines)

STATEMENT OF CLAIM: Claim of the General Committee of The Order of Railroad Telegraphers on the Southern Pacific Company (Pacific Lines) that:


(a) Carrier violated the provisions of the agreement between the parties when it required or permitted employes not covered by the terms of the Telegraphers' Agreement, as well as a Manager who is not classified as a Wire Chief, to perform routine duties of a Wire Chief at General Telegraph Offices of the Carrier at "BD" San Francisco, "DW" Portland and "HUI' Los Angeles.


(b) Carrier shall now properly compensate claimants named below on the dates listed;


(1) Mr. H. O. Norville, regularly assigned mechanician-assistant wire chief, eight hours' pay at time and one-half rate on December 18 and 19, 1954, for work denied on these days in "BD" Office.


(2) Mr. R. E. Ligon, regularly assigned relief wire chief, eight hours' pay at time and one-half rate December 20, 1954, for work denied in "BD" Office.


(3) Mr. W. Cross, regularly assigned wire chief, one hour and forty-five minutes overtime at time and one-half rate for work denied February 16, 1955; and, two hours and thirty minutes overtime at time and one-half rate for work denied March 4, 1955 in "DW" Office.


(4) Mr. A. B. Laing, regularly assigned wire chief-mechanician, for work denied in "1411" Office: January 31, 1955-eight hours at time and one-half rate; February 21, 1955-two hour call payment; March 1, 1955-two hours and forty-five minutes overtime at time and one-half rate.


(5) Mr. R. L. Shermer, regularly assigned wire chief-mechanician, two hour call payment for work denied February 9, 1955 in "HUI, Office.


(6) Mr. C. T. Miller, regularly assigned wire chief-mechanician, two hour call payment for work denied, March 1, 1955 in "HU" Office.

(c) For each day subsequent to the dates listed above that any similar violations occur at these General Telegraph Offices, the Carrier shall be required to compensate the available extra or regular assigned wire chief or mechanician-assistant wire chief, the proper compensation as provided under the terms of the Agreement.




That the dispute was certified to the Third Division of the Adjustment Board ex parts by the complainant party; and


That no hearing thereon has been held, and under date of February 1, 1956, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
