STATEMENT OF CLAIM: Claim of the General Committee of The Order of Railroad Telegraphers on the New York Central Railroad, Line West of Buffalo, that:
(1) The Carrier violated the provisions of the Agreement between the parties when it failed, on Sunday, February 10, 1952, to compensate John Sklenar for 8 hours at the rate of time and one-half for work performed on a rest day of his regular assignment, and instead paid him at the straight time rate of the position to which he had been diverted.
(2) The Carrier shall be required to pay John Sklenar the difference between the straight time rate and the rate of time and one-half for 8 hours for the work performed, February 10, 1952.
That the dispute was certified to the Third Division of the Adjustment Board ex parte by the complainant party; and
That hearing thereon has been held and concluded. Under date of February 21, 1956, the parties jointly addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case from further consideration by the Division, which request is hereby granted.
