NATIONAL RAILROAD ADJUSTMENT BOARD
PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
THE NEW YORK CENTRAL RAILROAD COMPANY (Line West)
STATEMENT OF CLAIM: Claim of the General Committee of the
New York Central Railroad, Line West of Buffalo, that:
(1) Carrier violated the terms of the prevailing agreement
between the parties, when on February 2, 3, 9 and 10, 1952, it
failed to compensate H. V. Kantz at the time and one-half rate
for work performed on the sixth and seventh days of the work
week of the first shift position, Elkhart, Indiana.
(2) Carrier shall now be required to compensate H. V. Kantz
for the difference between the straight time rate at eight hours
which he received and the time and one-half rate at eight hours to
which he was entitled for the work performed on the dates stated
in paragraph 1.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
That hearing thereon has been held and concluded. Under date of
February 21, 1956, the parties jointly addressed a formal communication to
the Secretary of the Third Division requesting withdrawal of this case from
further consideration by the Division, which request is hereby granted.
AWARD
Claim dismissed.
