PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
THE NEW YORK CENTRAL RAILROAD COMPANY (Line West)
STATEMENT OF CLAIM: Claim of the General Committee of The
Order of Railroad Telegraphers on The New York Central Railroad (Line
West of Buffalo) that:
1. Carrier violated the terms of the Agreement between the
parties when on March 28, 29, April 4, 5, 11 and 12, 1952, it failed to
compensate claimant Joseph Pohorecki for work performed while
diverted on the sixth and seventh days of Relief Assignment No. 5,
Group No. 8.
2. Carrier shall compensate claimant, Joseph Pohorecki, for
the difference between the straight time rate paid him and the
time and one-half rate to which he was entitled for the eight hours
worked on each of the days enumerated in paragraph number 1.
3. Carrier violated the terms of the Agreement between the
parties when on March 23 24, 30 31 April 6, 7, 13 and 14,
1952, it suspended claimant, Joseph PAorecki, from working the
assigned hours of his regular assignment, Relief Assignment No.
5, Group No. 8.
4. Carrier shall compensate claimant, Joseph Pohorecki, for
eight (8) hours pay at the pro rata rate of Relief Assignment No.
5, Group No. 8, enumerated in paragraph number 3.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That hearing thereon has been held and concluded. Under date of
February 21 1956, the parties jointly addressed a formal communication
to the Secretary of the Third Division requesting withdrawal of this case
from further consideration by the Division, which request is hereby granted.
AWARD
Claim dismissed.
