PARTIES TO DISPUTE:



THE NEW YORK CENTRAL RAILROAD COMPANY (Line West)

STATEMENT OF CLAIM: Claim of the General Committee of The Order of Railroad Telegraphers on the New York Central Railroad (Line West of Buffalo), that:


1. Carrier violated Agreement between the parties hereto, when on the 15th day of May, 1952, at 8:25 A. M., and again at 3:18 P. M., it required and permitted Conductor Extra 1369 to perform work of block operator at Grosvenor, Michigan.


2. Carrier shall be required to permit joint check of records to determine day and date of violations occurring at Grosvenor, Michigan, subsequent to May 15, 1952, when it required and permitted a train service employe to perform work of block operator.


3. Carrier shall be required to compensate the senior idle employe, extra employe in preference, for eight hours, at the minimum rate of pay for block

Ferator on Seniority District No. 5, for each and every date, commencing ay 15, 1952, a train service employe has been required and permitted to perform service of block operator at Grosvenor, Michigan.




That the dispute was certified to the Third Division of the Adjustment Board ex parts by the complainant party; and

That no hearing thereon has been held, and under date of February 21, 1956, the parties jointly addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
