STATEMENT OF CLAIM: Claim of the General Committee of The Order of Railroad Telegraphers on the New York Central Railroad (Line West), that:
1. The Carrier violated the terms of the Agreement between the parties on February 11, May 24, August 8 and 18, 1948, and July 8, 1949, and any subsequent days that it required or permitted train service employes, not subject to said agreement, to perform the work of a telephone and/or block operator at Rolling Prairie, Indiana, in the handling of (verbal) train orders, essential to the operation and movement of trains, direct with the train dispatcher, at times when the agent-telegrapher, G. W. Hoover, was available but not on duty.
2. The Carrier further violated the agreement when it failed to call agent-telegrapher, G. W. Hoover, on the dates aforesaid and any subsequent day to perform te work covered by the agreement.
3. The Carrier shall be required to compensate G. W. Hoover for the payment of a "call" under Article 5 of the Telegraphers' Agreement for each of the above named dates and on each of the subsequent dates that these violations occurred at Rolling Prairie.
That the dispute was certified to the Third Division of the Adjustment Board ex parts by the complainant party; and
That hearing was waived and under date of February 21, 1956, the parties jointly addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
