PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
THE NEW YORK CENTRAL RAILROAD COMPANY (Line West)
STATEMENT OF CLAIM: Claim of the General Committee of The
Order of Railroad Telegraphers on the New York Central Railroad, Line
West of Buffalo, that:
1. The Carrier violated the terms of the Telegraphers' Agreement when on August 14, 1952, it required or permitted the Engineer of Extra 8624 South to carry from Dunkirk, New York to
Titusville , Pennsylvania, Train Order No. 205, which was addressed
to Conductor and Engineman of Engine 8525, and which governed
the movement of Extra 8525 North from Titusville to Dunkirk,
and to deliver same to the crew of Extra 8525 North at Titusville.
2. The Carrier shall now be required to compensate the
Operator Clerk at Titusville, who was ready, willing and available
for this service for one "call" of 2 hours at the time and one-half
rate because he was not called to handle the train here involved.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That no hearing thereon has been held, and under date of February 21,
1956, the parties jointly addressed a formal communication to the Secretary
of the Third Division requesting withdrawal of this case, which request is
hereby granted.
AWARD
Claim dismissed.
