STATEMENT OF CLAIM: Claim of the General Committee of The
Order of Railroad Telegraphers on the New York Central Railroad (Line
West) that:
(1) The Carrier violated the Agreement between the parties
when beginning on May 19, 1952, and continuing thereafter, it
required or permitted employes not covered by the agreement to
perform the work of a telegrapher and/or block operator at Stonington, Ohio.
(2) The Carrier shall be required to compensate the senior
idle telegraphers, extra in preference, who shall be determined from
a joint check of Carrier's records, for a minimum of a day's pay
of eight hours for each day that the violation occurred at Stonington,
and continuing until the violations are corrected.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
That no hearing thereon has been held, and under date of February 21,
1956, the parties jointly addressed a formal communication to the Secretary
of the Third Division requesting withdrawal of this case, which request is
hereby granted.
AWARD
Claim dismissed.
