THE NEW YORK CENTRAL RAILROAD COMPANY (Line West)
STATEMENT OF CLAIM:
Claim of the General Committee of The
Order of Railroad Telegraphers on the New York Central Railroad, Line
West of Buffalo, that:
1. Carrier violated the agreement when it failed to assign
Marie Kass, who was the regular occupant of a 7-day position in
"SC" Telegraph Office, Chicago, Ill., to work the rest day relief
assignment on her position when neither the regular relief employe
nor extra employe was available on Thursday, August 21 1952;
Friday, August 22, 1952; Saturday, October 18, 1952 and Sunday,
October 19, 1952.
2. Carrier shall now compensate Marie Kass for 8 hours at the
time and one-half rate for August 21 and 22; October 18 and
October 19, 1952.
3. Carrier violated the agreement when it failed to assign
Mrs. J. S. Smith, who was the regular occupant of a 7-day position
in "SC" Telegraph Office, Chicago, Ill., to work the rest day relief
assignment of her position when neither the regular relief employe
nor an extra employe was available on Sunday, July 20, 1952.
4. Carrier shall now compensate Mrs. J. S. Smith for 8 hours
at the time and one-half rate for July 20, 1952.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
That no hearing thereon has been held, and under date of February 21,
1956, the parties jointly addressed a formal communication to the Secretary
of the Third Division requesting withdrawal of this case, which request is
hereby granted.
AWARD
Claim dismissed.
