STATEMENT OF CLAIM: Claim of the System Committee of the
Brotherhood:
(1) That the Carrier failed to apply Rule 54 of the Clerks'
Agreement in connection with the case of C. E. Avery who returned from military service, when pay was deducted from his
salary on March 11 and April 13, 1955 when he was absent from
duty account of illness.
(2) That Mr. Avery be compensated for March 11 and
April 13, 1955, and that his sick leave time be recognized for the
remaining portion of the year 1955.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
That no hearing thereon has been held, and under date of February 29,
1956, the complainant party addressed a formal communication to the Seeretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
AWARD
Case dismissed.
