PARTIES TO DISPUTE:
BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS,
FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
UNION PACIFIC RAILROAD COMPANY
STATEMENT OF CLAIM: Claim of the System Committee of the
Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and
Station Employes that
(1) Carrier violates Agreement effective February 1, 1952
when they assigned and continue to permit Telegrapher-Clerk
to perform rest day work of employe classified as Ticket Clerk,
H. B. Piland, Manhattan, Kansas.
(2) Carrier shall now pay Ticket Clerk H. B. Piland two
additional days' pay at time and one-half rate of Ticket Clerk
position from October 29, 1954 (date filed with Union Pacific Agent,
Manhattan, Kansas) until such time as this violation is corrected.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That no hearing thereon has been held, and under date of July 16, 1956,
the complainant party addressed a formal communication to the Secretary of
the Third Division requesting withdrawal of this case, which request is hereby
granted.
AWARD
Case dismissed.
