STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that:

The discipline of suspension imposed on J. A. Mitchell, Redcap, from August 25th to September 7th, 1954, inclusive, be removed from his service record and that he be reimbursed for an monetary loss sustained by reason thereof.

OPINION OF BOARD: Claimant was disciplined pursuant to rules of agreement, and, despite a difference of opinion yet existing between the parties to the contract which mainly puts in issue that which we look upon as a question of veracity, there appears in the record no reasonable basis for holding that discipline was improperly invoked or that same is not just.

FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon, and upon the whole record and all the evidence, finds and holds:

That the Carrier and the Employes involved in this dispute are respectively Carrier and Employes within the meaning of the Railway Labor Act, as approved June 21, 1934;

That this Division of the Adjustment Board has jurisdiction over the dispute involved herein; and

That the Agreement was not violated.
