STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that:


(1) The terms of the Clerks' Contract were violated June 2, 1956, when on this day Carrier permitted or required Mr. P. Seal, Traffic Representative, to perform the duties of General Clerk, such as, revising LCL shipments due to influx of business.


(2) That Mr. K. O. Mayfield, regularly assigned General Clerk with assigned hours of 8:30 A. M. to 5:00 P. M., be paid six hours at time and one-half rate because of the above violation of the Clerks' Contract.




That the dispute was certified to the Third Division of the Adjustment Board ex parts by the complainant party; and


That no hearing thereon has been held, and under date of October 24, 1956, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request is hereby granted.
