NATIONAL RAILROAD ADJUSTMENT BOARD
PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
ST. LOUIS-SAN FRANCISCO RAILWAY COMPANY
STATEMENT OF CLAIM: Claim of the General Committee of The
Order of Railroad Telegraphers on the St. Louis-San Francisco Railway, that:
1. Carrier violated Article II of the August 21, 1954 Agreement between the parties when it failed and refused to properly
compensate J. W. Kleeschulte for eight hours' pay at the pro rata
hourly rate of the Agent-telegraphers position, Cherryvale, Kansas,
to which he was assigned for Decoration Day, May 30, 1955.
2. Carrier shall now compensate J. W. Kleeschulte for the
difference between the rate of pay of second shift telegrapher position, Cherryvale, Kansas, which it paid him, and the rate of pay
of te agent-telegrapher position to which he was entitled, a difference of $.30 per hour, for eight hours making a total amount of
the claim $2.40 for May 30, 1955.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That no hearing thereon has been held, and under date of November
27, 1956, the complainant party addressed a formal communication to the
Secretary of the Third Division requesting withdrawal of this case, which
request is hereby granted.
AWARD
Case dismissed.
