PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS,

FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES




STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that-


(a) The Carrier violated the Clerks' Agreement at the Baggage and Mail Department, 12th Street, Central Station, Chicago, Illinois, when, on October 7, 1952, it required Clerk B. Mandarino, Lead Baggage Handler Joe Valentas, Baggage Handler Jack Daley and Mail Handler J. Hersham to suspend work on their regular assigned positions to absorb overtime.


(b) That Messrs. B. Mandarino, J. Valentas, J. Daley, and J. Hersham be compensated an additional day's pay at the pro rata rate of their respective regular assigned positions.


(c) That Parcel Clerk C. Lass be compensated for wage loss suffered on October 7, 1952, representing eight hours' pay at punitive rate of pay attaching position regularly assigned to Baggage Clerk R. Nelson.


FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon, and upon the whole record and all the evidence, finds and holds:


That the Carrier and Employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act, as approved June 21, 1934;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein;


That the dispute was certified to the Third Division of the Adjustment Board ex parts by the complainant party; and


That hearing thereon has been held and concluded. Under date of November 20, 1956, the parties jointly advised the Secretary of the Third

Division of their desire to withdraw this case from further consideration by the Division, which request is hereby granted.



    Case dismissed.
