BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS,
FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood that Carrier violated terms of the Clerks' Agreement:
1. When during period May to August 1951 it arbitrarily removed certain regular assigned clerical workers in the Auditor of Freight Receipts Office at Chicago off their regular assignments as Verification Clerks to compile and prepare special statements that are not a part of their regular normal assigned duties.
2. That the Carrier now be required to pay each employe involved for the number of hours that each one was required to suspend work on his regular assignment to work on the special statements as also to senior employes the equivalent number of hours that they were deprived of the right to perform work on special statements by reason of their superior seniority over employes who were actually assigned to that work.
NOTE: Detailed statement of employes' claims and their time due attached hereto as Employes' Exhibit A and by this reference thereto is made a part hereof.
FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon, and upon the whole record and all the evidence, finds and holds:
That the Carrier and Employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act, as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the dispute involved herein;
That the dispute was certified to the Third Division of the Adjustment Board ex parte by the complainant party; and
That hearing thereon has been held and concluded. Under date of November 20, 1956, the parties jointly advised the Secretary of the Third
