STATEMENT OF CLAIM:
Claim of the system committee of the
Brotherhood:
(1) That Carrier violated the Clerks' current Agreement by its
action on or about June 18, 1951, when it required Yard Clerk D. M.
Temple of Shreveport, Louisiana, to suspend that portion of his
regularly assigned duties of checking cars at the Barksdale Air Force
Base, and contracted that portion of his duties to the L&A Railway
Company at Shreveport, Louisiana.
(2) That Yard Clerk D. M. Temple be paid an additional one
hour and fifteen minutes per day for 110 days, which represents the
number of regularly assigned work days on his position between
June 18 and December 1, 1951, and that he be paid two hours for
each of the 20 Saturdays between June 18 and December 1, 1951.
These days do not include the 10 working days and 3 Saturdays of
his vacation period July 23 through August 3, 1951. The time
claimed to be figured at one and one-half times his rate of pay, and
to be in addition to what he has already been paid during same period
of time.
FINDINGS:
The Third Division of the Adjustment Board, after giving
the parties to this dispute due notice of hearing thereon and upon the whole
record and all the evidence, finds and holds:
That carrier and employe involved in this dispute are respectively
carrier and employe within the meaning of the Railway Labor Act, as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the
dispute involved herein;
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That hearing thereon has been held and concluded. Under date of
November 7, 1956, the parties jointly advised the Secretary of the Third

Division of their desire to withdraw this case from further consideration by
the Division, which request is hereby granted.
AWARD
Case dismissed.
