PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
THE CENTRAL RAILROAD COMPANY OF NEW JERSEY
STATEMENT OF CLAIM:
Claim of the General Committee of The
Order of Railroad Telegraphers on The Central Railroad of New Jersey, that:
1. The Carrier violated the Agreement between the parties
when on August 2 4, 9, 11 and 12, 1955, and on each subsequent
date that the violation continues, it required or permitted an employe not covered by the scope of said Agreement to copy train
orders at Royce, New Jersey, outside the assigned hours of the
Agent; and
2. The Carrier shall now be required to pay J. Posternock,
the regular assigned Agent at Royce, entitled to the work, a call of
two (2) hours at the time and one-half rate in accordance with the
provisions of Article 27 (a) for each such violation.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That no hearing thereon has been held, and under date of November 26,
1956, the parties jointly addressed a formal communication to the Secretary
of the Third Division requesting withdrawal of this case, which request is
hereby granted.
AWARD
Claim dismissed.
