BROTHERHOOD OF MAINTENANCE OF WAY EMPLOYES
CHICAGO, MILWAUKEE, ST. PAUL AND PACIFIC RAILROAD
COMPANY
STATEMENT OF CLAIM: Claim of the System Committee of the
Brotherhood that:
(1) The Carrier violated the effective Agreement on various
dates in July and August, 1955 when it assigned employes of a
general contractor to perorm the historical and traditional duties
of Roadway Equipment Machine Operators in the Yards at Spokane,
Washington;
(2) Roadway Equipment Machine Operator H. C. Schwanz be
allowed eight (8) hours' pay at his respective straight time rate on
July 12, 13, 19, 20 and August 2, 3 and 9, 1955; and Roadway
Equipment Machine Operator Orin Leggett be allowed eight (8)
hours' straight time pay for July 26, 27 and August 2 and 3,
1955, account of the violation referred to in part one (1) of this
claim.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board jointly by the parties; and
That no hearing thereon has been held, and under date of December 11,
1956, the parties jointly addressed a formal communication to the Secretary
of the Third Division, requesting withdrawal of this case, which request is
hereby granted,
AWARD
Case dismissed.
