STATEMENT OF CLAIM:
Claim of the System Committee of the
Brotherhood that:
(a) The Carrier violates the Agreement between the parties,
currently effective June 1, 1953 when it requires Cashier-Ticket Clerk
H. W. Phillips at Prairie du Chien, Wisconsin to 811 7-day position
on the 6th and 7th day by requiring him to work two recurring calls
on each Saturday, Sunday and Holiday subsequent to December 3,
1955, instead of working him 8 hours as provided in the Rules Agreement, and,
(b) That Cashier-Ticket Clerk H. W. Phillips be allowed the
difference between the amounts he received and 8 hours or minimum
day's pay at the punitive rate for Saturday December 3, 1955 and for
each Saturday, Sunday and Holiday subsequent thereto until the
condition is corrected.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That no hearing thereon has been held, and under date of November 29,
1956 the parties jointly advised the Secretary of the Third Division of their
desire to withdraw this case, which request is hereby granted.
AWARD
Case dismissed.
