PARTIES TO DISPUTE:

BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS,
FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES



STATEMENT OF CLAIM: Claim of the System Committee of the Brotherhood of Railway and Steamship Clerks, Freight Handlers, Express and Station Employes that


when they refused to allow Mr. G. T. Hansen two days' vacation on May 31 and June 1, 1955 but insisted he take three days May 30 to June 1, 1955, inclusive; Carrier violated same agreement when they refused to allow Mr. E. C. Johnson one day's vacation May 31, 1955 and insisted he take two days' vacation to include May 30 and 31, 1955; Carrier also violated the December 17th, 1941 National Vacation Agreement when they refused to allow Mrs. Beatrice Paulsen to take four days' vacation from July 5, 1955 to and including July Sth, but insisted that she take five days to include July 4 to July 8, 1955.




FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon and upon the whole record and all the evidence, finds and holds:


That the Carrier and the Employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act, as approved June 21, 1934;


That this Division of the Adjustment Board has jurisdiction over the dispute involved herein;


That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and


That hearing thereon has been held and concluded. Under date of January 25, 1957, the parties jointly addressed a formal communication to the Secretary of the Third Division, requesting withdrawal of this case from further consideration by the Division, which request is hereby granted.
