PARTIES TO DISPUTE:
THE ORDER OF RAILROAD TELEGRAPHERS
GULF, MOBILE AND OHIO RAILROAD COMPANY
STATEMENT OF CLAIM:
Claim of the General Committee of The
Order of Railroad Telegraphers on the Gulf, Mobile and Ohio Railroad that,
1. Carrier violated the Telegraphers' Agreement when on the
24th day of November, 1955 (a designated
holiday), it
caused, required and permitted employes not covered by said agreement to
perform regular duties of second shift telegrapher, at "RK" Meridian,
Miss., thereby improperly relieving W. L. Hurt, second shift telegrapher; and
2. Carrier shall now be required to compensate Claimant W. L.
Hurt for eight (S) hours at the time and one-half rate of pay applicable to the position on which work was diverted from, and which
W. L. Hurt was entitled to perform.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That no hearing thereon has been held, and under date of January 25,
1957, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request
is hereby granted.
AWARD
Claim dismissed.
