AMERICAN TRAIN DISPATCHERS ASSOCIATION
CENTRAL OF GEORGIA RAILWAY COMPANY
STATEMENT OF CLAIM:
Claim of the American Train Dispatchers
Association that:
(a) The Central of Georgia Railway Company, hereinafter referred to as the "Carrier", failed and continues to fail to comply with
the provisions of the currently effective Agreement between the
parties, particularly Article 3 thereof when, by unilateral action,
pursuant to Superintendent's Circular No. 53-215, File 103, dated
September 28, 1953, it commenced, effective September 30, 1953,
doubling the territory of the two first trick positions in its Macon,
Georgia dispatching office on Saturdays and Sundays of each week
for rest day relief purposes.
(b) The Carrier shall now pay to all train dispatchers adversely
affected by the above cited violation of the Agreement rules, one
day's pay at pro rata rate of trick train dispatchers for each day
such violation continues commencing with April 18, 1956 and ending
when said violation is corrected.
(c) A joint check of the Carrier's time rolls (pay rolls) shall
be made by the Carrier and the General Chairman of the American
Train Dispatchers Association to determine those entitled to the payments required by paragraph (b) of this claim.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by complainant party; and
That no hearing thereon has been held, and under dates of January 23
and January 28, 1957 both parties addressed a formal communication to the
Secretary of the Third Division withdrawing this case, which request is hereby
granted.
AWARD
Case dismissed.
