STATEMENT OF CLAIM:
Claim of the System Committee of the
Brotherhood that:
(1) The Carrier violated the Agreement on December 3, 9 and
12, 1955 and on January 2, 5, 8, and 12, 1956 when it assigned or
otherwise permitted employes excepted from the scope of the Agreement to supervise and direct laborers from Extra Gang No. MM-1 in
performing work during overtime hours;
(2) Foreman J. S. Hammonds, who was in charge of and had
jurisdiction over Extra Gang No. MM-1, be allowed pay at the time
and one-half rate of his position for the following number of hours:
12-3-55 3 hours
12-9-55 3 hours
12-11-55 2%% hours (a minimum call)
1-2-56 22,1 hours (a minimum call)
1-5-56 24/y hours (a minimum call)
1-8-56 22/3 hours (a minimum call)
1-12-56 2sZs hours (a minimum call)
Total 19 ys hours.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by complainant party; and
That no hearing thereon has been held, and under date of February 1,
1957, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request
is hereby granted.
AWARD
Case dismissed.
