FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
THE BALTIMORE AND OHIO RAILROAD COMPANY
STATEMENT OF CLAIM:
Claim of the System Committee of the
Brotherhood that:
(1) Carrier violated the Agreement when it permitted an independent contractor to handle mail to and from the post office and
station at Harpers Ferry, West Virginia, on various dates, and
(2) That as a result of such violation Carrier now be required to
compensate Baggage & Mail Porter J. L. McBee for one day's pay
at the punitive rate on October 1, 1955 and similar claims of record
on subsequent dates; and Baggage & Mail Porter D. L. McBee for
one day's pay at the punitive rate on October 15, 1955 and similar
claims of record on subsequent dates.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
That no hearing thereon has been held, and under date of January 30,
1957, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this case, which request
is hereby granted.
AWARD
Case dismissed.
