STATEMENT OF CLAIM: (a) Carrier violated the rules of the current Clerks' Agreement at Winslow, Arizona, when it required and permitted the Express Cashier to suspend service on his regular assigned position to absorb overtime on position of Ticket Cashier; and,
(b) Mr. A. H. Miller, Express Cashier, shall be compensated for one (1) hour and thirty (30) minutes each day, Monday through Friday, at the prorate. rate Express Cashier's rate, excluding Holidays, commencing January 31 1955, and continuing until such violation of Agreement rules is corrected; and
(c) Mr. J. C. Wamble Ticket Cashier, shall now be compensated for one (1) hour and thirty (30) minutes at punitive Ticket Cashier's rate for each day, Tuesday through Friday, excluding Holidays, commencing February 1, 1955 and continuing until such violation of Agreement Rules is corrected; and,
(d) Mr. G. T. Kaliss, Relief Clerk, shall now be compensated for one (1) hour and thirty (30) minutes at punitive Ticket Cashier's rate for each Monday, excluding Holidays, commencing January 31, 1955 and continuing until such violation of Agreement Rules is corrected.
FINDINGS: The Third Division of the Adjustment Board, after giving the parties to this dispute due notice of hearing thereon and upon the whole record and all the evidence, finds and holds:
That the Carrier and the Employes involved in this dispute are respectively carrier and employes within the meaning of the Railway Labor Act, as approved June 21, 1934;
That this Division of the Adjustment Board has jurisdiction over the dispute involved herein;
That the dispute was certified to the Third Division of the Adjustment Board ex parts by complainant party; and
