BROTHERHOOD OF RAILWAY AND STEAMSHIP CLERKS,
FREIGHT HANDLERS, EXPRESS AND STATION EMPLOYES
THE ATCHISON, TOPEKA AND SANTA FE RAILWAY
COMPANY (Eastern Lines)
STATEMENT OF CLAIM:
Claim of the System Committee of the
Brotherhood that:
(a) Carrier violated the Vacation Agreement when it failed and
refused to schedule a 10-day vacation period for D. R. Buckley
starting July 2; W. R. Brown starting July 30; P. Gusman starting
February 20; F. M. Garcia starting February 1; E. Paige starting
April 2; A. D. St. Clair starting August 1; D. J. Miller starting
January 15; R. Riskowsky starting September 10, and a 5-day
vacation period for R. Denning starting January 2, and a 7i/z-day
vacation period for N. Whitmore starting July 3; and,
(b) Carrier shall now schedule and grant the above vacation
periods as requested by the employes named; and,
(c) Carrier shall pay each employe named above at the rate
of time and one-half for services rendered during the vacation
period he requested in writing and which is spelled out in (a) above,
in addition to his regular vacation allowance.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parts by the complainant party; and
That no hearing thereon has been held, and under date of January 10, 1957,
the parties jointly addressed a formal communication of the Secretary of the
Third Division requesting withdrawal of this case, which request is hereby
granted.
AWARD
Case dismissed.
