PARTIES TO DISPUTE:





STATEMENT OF CLAIM: Claim of the General Committee of The Order of Railroad Telegraphers on the Western Maryland Railway, that:


1. Carrier violated the Telegraphers' Agreement when it caused, required or permitted train service employes to handle (receive, copy and deliver) train orders as follows











Agent-Operators at the respective points were ready and willing to perform this work but were not called.


2. Carrier shall compensate J. F. Flora, Agent-Operator, Oldtown Maryland, for two calls on February 21, 1956; H. E. Kershner, Agent. Operator Hancock, Maryland, for call on February 22 and a call on March 3, 1956; R. E. Trich, Agent-Operator, Big Spring, Maryland, one call on March 3, 1956.




That the dispute was certified to the Third Division of the Adjustment Board ex parte by the complainant party; and


That no hearing thereon has been held, and under date of February 28, 1957, the complainant party addressed a formal communication to the Secretary of the"Third Division requesting withdrawal of this case, which request is hereby granted.
