STATEMENT OF CLAIM:
Claim of the General Committee of The
Order of Railroad Telegraphers on the Virginian Railway, that: -
1. Carrier violated Article 1 of the Agreement when on January
2, 5, 11, 12, 17 and 18, 1955, it required or permitted conductors, employes not covered by the Telegraphers' Agreement, to perform the
work of receiving and copying work permit cards at Slab Fork,
West Virginia, after the Agent-Telegrapher was off duty.
2. Carrier shall compensate W. B. Robinson, Agent-Telegrapher, Slab Fork, West Virginia, for a call for January 2, 5, 11,
12, 17 and 18, 1955.
FINDINGS:
The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by the complainant party; and
That hearing thereon has been held but not concluded, and under
date of March 12, 1957, the complainant party addressed a formal communication to the Secretary of the Third Division requesting withdrawal of this
case, which request is hereby granted.
AWARD
Claim dismissed.
