PARTIES TO DISPUTE:
BROTHERHOOD OF MAINTENANCE OF WAY EMPLOYES
CHARLESTON AND WESTERN CAROLINA
RAILWAY COMPANY
STATEMENT OF CLAIM: Claim of the System Commitee of the
Brotherhood that:
(1) The Carrier violated the effective Agreement when it
assigned Machine Operators H. C. Harmon, J. D. Harmon, Roy
L. Godwin and H. H. Ringer to perform temporary service away
from their regular headquarters and failed and refused to allow
these employes one hour's pay for each meal and one hour for
lodging while so assigned.
(2) Each of the Claimants referred to in Part (1) of this
claim be allowed one hour's pay at their respective straight time
rates for each meal and one hour for lodging for each day they were
engaged in performing the temporary service referred to in Part
(1) of this claim.
FINDINGS: The Third Division of the Adjustment Board finds:
That the dispute was certified to the Third Division of the Adjustment
Board ex parte by complainant party; and
That no hearing thereon has been held. and under date of May 22, 1957,
the complainant party addressed a formal communication to the Secretary
of the Third Division, requesting withdrawal of this case, which request is
hereby granted.
AWARD
Case dismissed.
